1. License grant
Subject to your compliance with this Agreement, JDL Solutions for Design & Programing W.L.L. grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and install the Application on a device that you own or control and to use it for your personal, non-commercial purposes.
2. License restrictions
You shall not, and shall not permit others to:
- Copy, modify, or create derivative works of the Application except as expressly permitted by law;
- Distribute, sell, lease, rent, lend, or sublicense the Application;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code, except to the extent applicable law prohibits this restriction;
- Remove, alter, or obscure any proprietary notices on the Application;
- Use the Application to develop a competing product or for any unlawful purpose.
3. Ownership
The Application is licensed, not sold, to you. JDL Solutions for Design & Programing W.L.L. and its licensors retain all right, title, and interest in and to the Application, including all intellectual property rights. No rights are granted to you other than as expressly set out in this Agreement.
4. Updates
We may from time to time provide updates, patches, or new versions of the Application. Such updates may be automatically installed and are subject to this Agreement unless accompanied by a separate license.
5. In-app purchases and content
The Application may offer in-app purchases and virtual items, which are licensed to you for use within the Application only. They have no real-world value and are non-transferable. Purchases are handled by the relevant app store and are subject to its terms.
6. Third-party terms
Your use of the Application is also subject to the terms of the platform from which you obtained it (for example, the Apple Media Services Terms or Google Play Terms of Service). Where this Agreement conflicts with applicable app store terms, the app store terms govern with respect to your acquisition of the Application.
Apple-specific terms
This Agreement is between you and JDL Solutions for Design & Programing W.L.L. only, not with Apple. Apple is not responsible for the Application or its content. Apple has no obligation to provide maintenance or support for the Application. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
7. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must stop using the Application and delete all copies. Sections that by their nature should survive will survive termination.
8. Disclaimer of warranties
The Application is provided “as is” and “as available” without warranty of any kind. To the maximum extent permitted by law, JDL Solutions for Design & Programing W.L.L. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, JDL Solutions for Design & Programing W.L.L. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising out of or related to your use of or inability to use the Application.
10. Export compliance
You represent that you are not located in a country subject to a government embargo and that you are not listed on any government list of prohibited or restricted parties.
11. Governing law
This Agreement is governed by the laws applicable in JDL Solutions for Design & Programing W.L.L.’s principal place of business, without regard to conflict-of-law rules.
